General Terms and Conditions (AGB)
Diamond Aesthetics
1. scope of application
(1) These General Terms and Conditions apply to all contracts between Diamond Aesthetics Clinic and its patients/clients, unless expressly agreed otherwise in writing.
(2) Deviating terms and conditions of the customer shall not apply unless Diamond Aesthetics has expressly agreed to their validity in writing.
2. service description
(1) Diamond Aesthetics provides medical-aesthetic services (e.g. surgical procedures, minimally invasive treatments, consultations).
(2) The type and scope of treatment are determined individually with the patient. A specific treatment success cannot be guaranteed.
(3) Follow-up treatments, check-up appointments or corrections are not included in the treatment price, unless agreed separately.
3. medical information and consent
(1) Before each procedure, a comprehensive medical explanation of the type, scope, risks, possible side effects, alternatives and the prospects of success of the treatment is provided.
(2) The information is documented. The patient confirms with his signature that he has understood and consents to the treatment.
(3) No treatment shall take place without legally valid consent.
4 Prices and terms of payment
(1) All prices are final prices in euros and include – where applicable – the statutory value added tax.
(2) The agreed treatment price is due before the treatment, unless payment in installments or another method of payment has been expressly agreed in writing.
(3) In the event of late payment, default interest at the statutory rate and reminder fees may be charged.
5. appointments and cancelation
(1) Binding appointments are agreed.
(2) Cancellations can be made free of charge up to 48 hours before the appointment at the latest. Diamond Aesthetics reserves the right to charge a cancellation fee of €50 for later cancellations or no-shows.
(3) If an appointment has to be postponed by Diamond Aesthetics for medical or organizational reasons, the patient will be informed immediately. There are no claims for compensation due to postponement.
6. right of withdrawal
(1) Consumers generally have a 14-day right of withdrawal for distance selling contracts.
(2) However, this right of revocation shall lapse as soon as Diamond Aesthetics has started the treatment with the express consent of the patient or the service has been provided in full (Section 356 (4) BGB).
(3) The patient is informed of this prior to the start of treatment and confirms this with his/her signature.
7. liability
(1) Diamond Aesthetics shall be liable without limitation in cases of intent and gross negligence.
(2) In the event of slight negligence, Diamond Aesthetics shall only be liable for breach of material contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract.
(3) Liability for non-guaranteed treatment successes is excluded.
(4) The statutory liability under the Product Liability Act remains unaffected.
8. data protection
(1) All personal data of the patient will be processed in accordance with the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).
(2) Detailed information on data protection can be found in the privacy policy on our website.
9 Place of jurisdiction and applicable law
(1) German law shall apply exclusively.
(2) If the customer is a merchant or has no general place of jurisdiction in Germany, the place of jurisdiction shall be the registered office of Diamond Aesthetics.
(3) Mandatory legal jurisdictions, in particular for consumers, remain unaffected.
10. final provisions
(1) Amendments or additions to the contract must be made in writing.
(2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected (severability clause).
(3) The version of these GTC valid at the time of conclusion of the contract shall always apply
